Booking conditions - Rental

Booking conditions
1. Introduction
1.1 Application and parties: These Booking Conditions apply to the hire of equipment and products booked by an individual ("Booking Agent") with any of the following group companies ("Supplier"):
- Hypersports Paintball & Event Sweden AB, corporate identity number 556574-9339, or

- GAMES2U Event Sverige AB, corporate identity number 559131-1542.
Which of the above companies is the contracting party depends on what is being booked:
- When booking a bouncy castle, obstacle course or other inflatable play equipment, and if the Booking Manager is not the operator for the entire event, the agreement is entered into with GAMES2U Event Sverige AB, which in this case also acts as Operator.

- In other cases, the agreement is concluded with Hypersports Paintball & Event Sweden AB.
The Booking Agent and the Supplier are hereinafter jointly referred to as the "Parties" and individually as a "Party".
1.2. The Supplier's range of products and services: The current availability of equipment/products for hire, including optional products and services, is shown on the Supplier's website spelapaintball.se (the "Website") and on the booking page provided by the Supplier's partners.
1.3 Applicable legislation: When booking by a consumer, the mandatory rules of the Distance Contracts Act (2005:59) and the Consumer Sales Act (2022:260) apply. These rules give the consumer rights that cannot be cancelled. More information on consumer rights is available at www.hallakonsument.se and www.konsumentverket.se.

2. Booking conditions
2.1 Eligibility requirements: The Booking Agent must be at least 18 years of age and have a Swedish personal identity number with no record of non-payment. By making a booking, the Booking Agent certifies that these requirements are met.
2.2 Booking contact details: The booking manager is responsible for providing complete and correct contact details, including name, mobile phone number and e-mail address, at the time of booking. This information is required for the Supplier to send a booking confirmation and relevant information about the equipment, service or product to which the booking relates. The Supplier is not liable for any errors or misunderstandings arising from incorrect or incomplete information provided by the Booking Agent.
2.3 When the booking becomes binding: The booking becomes legally binding for both the Booker and the Supplier at the moment the booking confirmation is sent to the e-mail address provided by the Booker when making the booking. The terms and conditions of the contract thus take effect immediately, regardless of whether payment has been made in full, in part or has not yet been made.
2.4 Responsibility for the entire booking: The booking manager is responsible for the entire booking, including for ensuring that any rebooking or cancellation is made in good time to be valid and for avoiding charges in the event of late or no rebooking or cancellation.
2.5 Acceptance of terms and conditions: By finalising a booking, the Booking Agent confirms that it has read and accepts these contractual terms and conditions, including the applicable product-specific rental terms and conditions as set out in section 8 ("Product-Specific Rental Terms and Conditions"). The booking amount will then be charged as indicated in the booking.

3. prices
3.1 All prices quoted on the Website, in the booking system, these contractual terms and conditions and applicable product-specific terms and conditions are quoted in Swedish kronor (SEK) and include value added tax (VAT).
3.2. The shopping basket and the checkout in the booking system present the total price including all charges, such as VAT and shipping.

4. terms of payment
4.1 Direct payment by card or Swish: Payment for the booking is made either by direct payment by card or by Swish. The payment can be made via a payment link or on site in connection with the collection of the equipment. For more information on Swish and how the service works, please visit www.swish.nu.
4.2 Payment service provider's terms and conditions: the person making the payment through the payment service provider's system is responsible for reading and accepting the provider's terms of use and information on the processing of personal data. The provider is not liable for the terms and conditions of third parties or any errors in the provision of the payment service.
4.3 Invoicing and fees: If payment is made by invoice, thirty (30) calendar days' payment terms apply. An invoice fee of SEK 95 (incl. VAT) per invoice will be charged.
4.4 Delay in payment: In the event of late payment, the Supplier is entitled to charge penalty interest from the due date in accordance with the Interest Act (SFS 1975:635) until full payment is made. The Supplier is also entitled to charge statutory fees for reminders and debt collection, to submit the claim to the Swedish Enforcement Authority and to take other legal measures to collect the debt.
4.5. Personal liability of the booking agent
4.5.1 At the Booking Agent's express request, and if the Supplier agrees, the booking may be invoiced to a company or another natural person, provided that the recipient is approved during any credit check. The Supplier reserves the right to examine and refuse such requests.
4.5.2 Regardless of whether the invoice, following an approved request, is issued to a company, an organisation or another natural person, the Bookings Officer is always ultimately liable for payment to the Supplier. This means that the Booking Agent is obliged to ensure that payment is made on time and in accordance with the agreed terms, even if it is someone other than the Booking Agent who is intended to make the payment.
4.5.3. In the event of non-payment or late payment, the Supplier shall be entitled to invoice the Booking Administrator for the entire outstanding amount. This includes any additional costs such as invoice fee, penalty interest in accordance with the Interest Act (1975:635), and statutory fees for reminders, debt collection or other collection measures.

5. right of cancellation does not apply - exception under the Distance Contracts Act
5.1. No right of cancellation applies to this booking under the Distance and Off-Premises Contracts Act (SFS 2005:59) (the "Distance Contracts Act"), as the contract relates to a leisure activity to be carried out on a specific date or during a specific period of time. The booking agent may instead reschedule or cancel under the conditions set out in section 6.

6. Cancellation and rescheduling
6.1. General
6.1.1 How to make a request: Requests for rebooking, cancellation or other changes to the booking should be made by the Booking Manager by email to: [email protected].
6.1.2 Consequences of late change or non-attendance: If a request for a change or cancellation is made later than the deadlines indicated below, or if the Booking Agent fails to show up for his/her booked time, the Booking Agent will be charged and invoiced the full fee for the booking (100 % of the agreed price).
6.1.3 When the change becomes valid: A change or cancellation request becomes valid only when it has been confirmed by the Supplier by means of a confirmation message sent to the e-mail address of the Booking Manager.
6.1.4 Booking Manager's verification responsibility: If the Booking Manager does not receive a confirmation message within 24 hours (working days only), it must contact the Supplier to ensure that the request has been received. If the Booking Agent does not receive a reply, the request is deemed not to have been received and is therefore invalid (for example, if the request was sent to the wrong e-mail address by the Booking Agent).

6.2. Rebooking
6.2.1. Ordinary rule: The Booking Manager has the right to rebook (i.e. make changes to the booking without cancelling) up to three (3) calendar days before the booked start time.
6.2.2 In the event of a rebooking guarantee: If the Booking Manager has opted for the additional service "Rebooking Guarantee" at the time of booking, rebooking can instead take place up to 24 hours before the booked start time.
6.3 Cancellation
6.3.1. Ordinary rule: The Booking Manager may make a cancellation free of charge up to and including seven (7) calendar days before the selected start time.
6.3.2 Cancellation for late bookings: If the booking is made within seven (7) calendar days before the chosen start time, the Booking Manager may cancel the booking free of charge until 09.00 on the next calendar day. Example: If the booking is made on 10 October for a start time on 15 October, cancellation can be made free of charge until 09.00 on 11 October.
6.3.3. No cancellation after the deadline: After the above-mentioned deadline, cancellation is not possible and the full fee for the reservation (100% of the agreed price) will be charged, if rebooking is not done in accordance with the rebooking conditions.

7. the equipment
7.1 Identification and payment on collection: When collecting rented equipment, the Booking Manager must present valid identification and any outstanding payment must be paid in advance.
7.2. Equipment check on receipt: Before using the equipment for the intended activity, the Booking Manager shall check that it is not damaged, faulty or otherwise different from what was booked. If the equipment is faulty or damaged, the Booking Manager is entitled to a replacement product (if available) or a full refund.
7.3 Responsibility for care during the rental period: Throughout the rental period, the Booking Manager is responsible for ensuring that the equipment is handled with care and in accordance with the applicable instructions. The Booking Agent is liable for damages incurred during the rental period, up to the full sales value of the equipment.
7.4 Full return requirement: All hired equipment (including any accessories) must be returned complete and in full by the date specified in the Booking Confirmation. If the equipment is not returned, the full retail value of the equipment will be charged to the Booking Manager.
7.5 Cleaning fee: Unless cleaning is explicitly purchased or included in the booking, all equipment must be returned in the same condition as when collected. This means that the equipment must be dry, clean and free of dirt, grass, mud, food residues, rubbish or other contamination. If the equipment is returned in a condition contrary to this, the Supplier is entitled to charge a cleaning fee. The fee varies depending on the degree of soiling and can amount to between SEK 200 and SEK 5,000 (incl. VAT). The booking manager is also responsible for taking into account weather conditions and other circumstances that may affect the condition of the equipment. A cleaning fee may be charged even if the soiling is caused by such external factors, unless otherwise agreed.
7.6 Liability for theft: If the equipment is stolen during the rental period and before it has been returned to the Supplier, the Booking Manager is fully liable for compensation.

8. product-specific rental conditions
8.1 Acceptance of Product Specific Terms and Conditions: By finalising a booking, the Booking Agent also accepts the relevant Product Specific Rental Terms and Conditions applicable to the specific equipment or products covered by the booking. The following documents constitute the applicable product-specific rental conditions:

8.2. Special responsibility as Operator when booking inflatable play equipment: When booking a bouncy castle, obstacle course or similar inflatable play equipment, the Booking Manager assumes a special responsibility as Operator of the event. This means that the Booking Manager must comply:
- the applicable product-specific rental conditions; and
- the requirements of Standard EN 14960-1:2019 for "Bouncy castles and similar inflatable play equipment".
By finalising such a booking, the Booking Agent confirms the following:
a) that the Booking Manager has received the information applicable to the role of Operator according to EN 14960-1:2019;
b) that the Booking Agent accepts its responsibility as Operator, in cases where the Supplier is not engaged to be on site during the event; and
c) that the Booking Manager has read the information in the links below:
- Routine inspection and user and safety instructions: http://www.spelapaintball.com/wp-content/uploads/2024/06/Rutininspektion.pdf

9 Complaints
9.1 Right to complain: The person responsible for the booking has the right to complain about faults or defects in the rented equipment, product or service, including in the event of a delivery delay. The complaint must be made within a reasonable time after the defect was discovered or should have been discovered. A complaint made within two (2) months of the discovery of the fault is always considered to have been received in time.
9.2. How to make a complaint: Complaints can be made in writing by e-mail or post, orally or by other means. However, for evidential reasons, it is recommended that complaints are made in writing, to the Supplier's contact details given at the end of these terms and conditions. A written complaint should include the Booking Manager:
- a clear description of the error,
- how and when the error was detected; and
- any other relevant information that could speed up the handling of the case.
9.2.1 Approved complaint: In the event of an approved complaint, any compensation will be refunded within thirty (30) calendar days. Refunds will be made using the same payment method used for the booking, unless otherwise specifically agreed between the Parties.
9.2.2 If the complaint is rejected: If, after investigation, it is found that the rented equipment, product or service is not defective under applicable law, the complaint will be rejected. In such a case, the Booking Agent may be obliged to reimburse the Supplier for the administrative costs linked to the handling of the complaint.
9.3. Remedial action
9.3.1 The Supplier's undertaking to remedy defects: If there is a defect under applicable law, the Supplier undertakes to remedy the defect or carry out a redelivery, with due diligence and at no cost to the Bookings Officer. This applies provided that the measure can be carried out without unreasonable cost to the Supplier.
9.3.2 Timeframe and alternative penalty: Rectification or redelivery shall take place within a reasonable time after the Booking Authority has made its claim. The action shall be taken without cost or significant inconvenience to the Booker. Even if the Booking Authority demands another penalty, such as a price reduction or cancellation, the Supplier is entitled to rectify the fault or carry out a redelivery in the first instance, provided that this is done within the framework of applicable law and without unreasonable inconvenience.

10. Limitation of liability
10.1 Limited liability for minor defects: The Supplier shall not be liable for defects that are not relevant to the intended use of the equipment, product or service and that do not cause any inconvenience to the Booking Agent, such as minor scratches, colour changes or other superficial defects that do not affect function or safety.
10.2. Defects due to unauthorised use, interference or negligence: The supplier is not liable for defects caused by:
- the equipment has been used in conjunction with other equipment or accessories that have adversely affected its operation,
- the Booking Agent or a third party has made changes or alterations to the equipment without the Supplier's written instructions or authorisation,
- negligence by the Booking Manager, third parties or other users, or use in breach of the user manual, safety instructions or applicable regulations.
10.3 Defects due to normal wear and tear, etc.: The supplier shall not be liable for defects or damage arising from normal operational maintenance, wear and tear or the need to replace consumables and accessories.
10.4 Force majeure and external events: The Supplier is not liable for faults or damage caused by circumstances beyond the Supplier's control, including but not limited to weather conditions, fire, flood, natural disasters, war, civil unrest, government action, pandemic or similar.
10.5 Faulty installation: The Supplier is not liable for faults or damage resulting from incorrect installation or assembly, unless this has been carried out by the Supplier or a representative authorised by the Supplier.
10.6 Failure to comply with instructions: The Supplier shall not be liable for any damage or failure arising from non-compliance with safety regulations, instructions from the Supplier or applicable legislation.

11. Processing of personal data
11.1 In order to receive, administer and fulfil the booking, the Supplier will process the Booking Manager's personal data. The processing is carried out in accordance with applicable data protection legislation, including the EU General Data Protection Regulation (GDPR).
11.2. More information on how the Supplier processes personal data, including contact details, legal basis and retention periods, can be found in our Privacy Notice - Information on the processing of personal data.
12. force majeure
12.1 The Supplier shall be exempt from any penalty for failure to perform its obligations under the Contract if the performance of the Contract is prevented or materially impeded by circumstances beyond the Supplier's control (such as government action, epidemic, pandemic, war, mobilisation or increased defence readiness, natural disaster, interruption of public communications, interruption of public energy supply or other comparable events). In such cases, the Supplier shall be entitled to suspend its obligations under the Contract and the Supplier shall not be liable for any damage or loss suffered by the Booking Agent as a result of such circumstances.
12.2. If a booking cannot be completed by the Supplier due to force majeure events, a cancellation will take place and the Booking Agent will not be charged for the booking and will be entitled to a refund for any advance payment made.

13. other provisions
13.1 Assignment of rights and obligations: The Supplier shall be entitled to assign its rights and/or obligations under the Contract, in whole or in part, without the consent of the Bookings Officer. The Bookings Officer may not assign his rights or obligations without the prior written consent of the Supplier.
13.2 Use of subcontractors: The Supplier is entitled to use subcontractors or partners to fulfil its obligations under the agreement. The Supplier is responsible to the Booking Manager for the fulfilment of the agreement even when subcontractors or partners are used. However, the Supplier is not liable for representations or promises that third parties may have made directly to the Booking Manager without the Supplier's knowledge and which the Supplier has not known or reasonably should have known.
13.3 Reservation for inaccuracies: The Supplier reserves the right to make obvious errors in product information, prices, availability or other information on the Website that the Booking Manager realises or should have realised is incorrect. Such errors may be due, for example, to printing or typing errors, technical errors or manual mistakes.
13.4 Intellectual property rights: All information and images on the Website are the property of the Supplier, its licensors or partners and may not be copied, distributed or used without authorisation. These contractual terms do not entail any transfer of intellectual property rights to the Booking Manager or third parties.
13.5 Illustrations and colour reproduction: The Supplier endeavours to ensure that images of equipment and products reproduce their appearance as accurately as possible. However, variations in colour and appearance may occur due to screen, light, photo quality or resolution. All image information should be considered as illustrations and not as a guarantee of exact appearance or condition.
13.6 Validity of provisions after termination of the contract: Provisions in the contractual terms and conditions relating to, for example, intellectual property rights, applicable law, dispute resolution and other provisions which, by their nature, are intended to continue to apply, shall remain binding even after the contract has otherwise expired.
13.7 Invalidity and adjustment: If any provision of the Agreement is held invalid or unenforceable in whole or in part by a court, arbitral tribunal or other competent body, this shall not affect the validity of the other provisions. To the extent that the invalidity affects the rights or obligations of any person, equitable adjustment shall be made.

14 Applicable law and dispute resolution
14.1 The booking and these conditions are governed by Swedish law.
14.2. If the Booking Manager is a consumer and has a dispute with the Supplier, it is possible to have the dispute reviewed by the National Board for Consumer Disputes (ARN), www.arn.se, Box 174, 101 23 Stockholm. The Booking Manager can also contact the Swedish Consumer Agency (www.konsumentverket.se) or their municipal consumer counselling service for free advice.
14.3. Until 20 March 2025, complaints can also be submitted via the EU Online Alternative Dispute Resolution (ODR) platform: http://ec.europa.eu/odr. After this date, it is no longer possible to register new cases and the platform will be permanently closed on 20 July 2025.
14.4 Disputes that cannot be resolved through alternative dispute resolution shall be finally settled by a Swedish court, unless otherwise provided by mandatory law.
14.5 The supplier always recommends that the parties first try to resolve disputes through dialogue and negotiation before taking legal action.
